1.2. BUYER (Consumer / Member / User)

The real or legal person who purchases or places an order for video or online education services (hereinafter referred to as “Service”) via www.birharf.com. Information provided by the BUYER at the time of order (name, address, phone, email, etc.) is taken as basis. This agreement is deemed concluded upon electronic approval by the BUYER.

2. DEFINITIONS

• Law: Law No. 6502 on the Protection of Consumers.
• Regulation: Regulation on Distance Contracts (OG: 27.11.2014/29188).
• Service: Any consumer transaction provided or promised in exchange for a fee or benefit, excluding the supply of goods (digital/online education within this agreement).
• Seller (Service Provider): The company offering services/goods to consumers within commercial or professional activity.
• Buyer (Consumer): The real or legal person acquiring, using or benefiting from goods/services not for professional/commercial purposes.
• Site: Website with domain www.birharf.com.
• Orderer: The person placing an order for a product or service on the site (may be the BUYER).
• Agreement: This Distance Sales Agreement between the SELLER and the BUYER.
• Goods: Tangible items and intangible goods prepared for electronic use, including software, audio, video (in this agreement: digital course contents).

3. SUBJECT OF THE AGREEMENT

This agreement regulates the rights and obligations of the parties regarding the sale and provision of digital/online video trainings, webinars, and other digital education services ordered by the BUYER via www.birharf.com.

7.2. Pricing

• All listed prices include VAT and may vary during campaign periods.
• The BUYER agrees to pay the listed price and any additional charges (tax, transaction fees, etc.).

7.3. Payment

• Payment can be made via credit/debit card, bank transfer, or EFT.
• Upon order completion, the BUYER gains access to the purchased service.

8. INVOICE

The invoice will be issued electronically and sent to the BUYER's declared email address.

9. GENERAL TERMS

• BUYER confirms to have reviewed all pre-information, usage terms, access duration and pricing details before purchasing.
• BUYER declares having read and accepted the Privacy and Security Policy and the Clarification Text on the Protection of Personal Data published on www.birharf.com.
• BUYER agrees to comply with the User Agreement while using the service.

10. RIGHT OF WITHDRAWAL

• BUYER can exercise the right of withdrawal within 14 days if access to the service has not been started.
• If access has begun with BUYER’s explicit consent, the right of withdrawal is forfeited.
• Withdrawal notice must be sent in writing or via email.
• Refunds are processed within 14 days upon a valid withdrawal claim.

11. CASES WHERE WITHDRAWAL RIGHT CANNOT BE EXERCISED

• Services tailored specifically for the consumer upon request.
• Instantly fulfilled digital content in electronic environment.
• If service has started with consumer’s consent.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on credit card payments, he/she shall pay interest and fulfill obligations as per the agreement with the bank. The SELLER reserves the right to claim damages and legal costs.

13. AUTHORIZED COURTS

• If the BUYER is a consumer: the Consumer Arbitration Committees and Consumer Courts in the place of residence.
• If the BUYER is a legal entity: Istanbul Central Courts and Enforcement Offices have jurisdiction.

14. ENFORCEMENT AND ACCEPTANCE

By making a payment on www.birharf.com, the BUYER declares that he/she has read, understood, and accepted this agreement in electronic form.

This agreement is stored electronically and the BUYER may obtain a copy at any time.
